These Terms and Conditions ("Terms," "Agreement") constitute a legally binding contract between you ("User," "Player," "You") and Draft King Operations, LLC, its parent companies, subsidiaries, and affiliates (collectively, "Draft King," "Company," "We," "Us," or "Our"). By accessing, browsing, registering an account, downloading our mobile applications, or utilizing any of the services provided on our platform—including our Sportsbook, iGaming Casino, and Daily Fantasy Sports (DFS) platforms (collectively, the "Services")—you expressly agree to be bound by these Terms.

By creating an account and checking the "I Agree" box, you acknowledge that you have read, understood, and accept these Terms in their entirety. Draft King reserves the absolute right to amend, modify, update, or revise these Terms at any time without prior individualized notice. To use our Services, you must be at least twenty-one (21) years of age (or eighteen (18) years of age where permitted strictly for Daily Fantasy Sports, depending on jurisdictional laws). Upon registration, you must provide accurate, current, and complete information, including your full legal name, date of birth, physical residential address, social security number (or relevant national identification), and email address. Draft King utilizes advanced third-party verification services to confirm your identity. Failure to pass identity verification will result in immediate account suspension or termination.
You may only participate in real-money gambling and sports betting when physically located within the borders of a state or jurisdiction where Draft King holds a valid license to operate (e.g., New Jersey, Pennsylvania, Michigan, West Virginia, Connecticut, etc.). We employ mandatory geolocation software to determine your physical location. Any attempt to circumvent this software, including but not limited to the use of Virtual Private Networks (VPNs), proxy servers, or location-spoofing applications, is strictly prohibited and constitutes grounds for permanent ban and forfeiture of all funds.
Users are strictly limited to opening and operating one (1) single account per person. Creating multiple accounts using different email addresses, variations of your name, or on behalf of third parties is a material breach of these Terms. If we discover multiple accounts linked to a single individual, all associated accounts will be permanently closed, and any associated winnings, bonuses, or ongoing bets will be voided without recourse.
All funds deposited into your Draft King account must be from a payment method legally registered in your name. We accept various funding methods, including credit/debit cards, bank transfers, and approved e-wallets. You agree not to execute any chargebacks, reversals, or otherwise cancel any deposits made into your account. In the event of a chargeback, Draft King reserves the right to suspend your account, initiate legal proceedings to recover the funds, and report the activity to credit reporting agencies.
Withdrawals are subject to internal processing and security checks. While we strive to process all withdrawals as rapidly as possible, times may vary based on the selected payment method and compliance reviews. Draft King securely holds all player funds in segregated bank accounts, ensuring that player balances are separate from the Company's operational funds, in strict accordance with state regulatory requirements.
All sports bets placed are subject to the specific Draft King House Rules, which are incorporated by reference into these Terms. Draft King relies on official league data to settle wagers. Once a bet is confirmed, it cannot be canceled or modified by the user.
In the event of an "Obvious Error" (also known as a palpable error)—such as incorrectly posted odds, a reversed spread, or lines offered on an event that has already occurred—Draft King reserves the right to void any wagers placed on those erroneous markets, even after the event has concluded. For our iGaming Casino, all outcomes are determined by an independently tested and certified Random Number Generator (RNG). In the event of a software malfunction or hardware failure, all affected plays and payouts are deemed void.
Draft King frequently provides promotional offers, deposit matches, risk-free bets, and free spins. These bonuses are subject to their own specific terms, including play-through (wagering) requirements, expiration dates, and eligible games. Unless otherwise stated, promotional funds cannot be withdrawn directly and must be wagered in accordance with the specific offer's rules. Draft King retains the right to revoke bonuses or ban users from future promotions if we determine, at our sole discretion, that a user is engaging in bonus abuse, risk-free arbitrage, or syndicate play.

Draft King is deeply committed to responsible gaming. We provide tools within your account settings that allow you to set daily, weekly, or monthly limits on your deposits, wagers, and time spent on the platform. If you feel you are losing control of your gambling habits, you may opt for a "cool-off" period or enter our voluntary self-exclusion program. By enrolling in self-exclusion, your account will be locked for the chosen duration, and you will be barred from creating new accounts. All content on the Draft King platform, including but not limited to logos, trademarks, text, graphics, software, algorithms, audio, and video, is the exclusive property of Draft King or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the platform for personal, non-commercial entertainment purposes only. You may not copy, reproduce, reverse-engineer, modify, or distribute any part of the Draft King software or brand without express written permission.
THE DRAFT KING PLATFORM AND ALL ASSOCIATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DRAFT KING DOES NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR IMMUNE TO CYBERATTACKS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DRAFT KING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT OF FUNDS CURRENTLY HELD IN YOUR ACCOUNT.
PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS. Any controversy, claim, or dispute arising out of or relating to these Terms, your account, or the Services shall be resolved exclusively through final and binding arbitration, rather than in court. The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State in which you are transacting (e.g., the laws of the State of New Jersey for bets placed within New Jersey), without regard to its conflict of law principles. Where federal law applies, the laws of the United States of America shall govern.
